Surrogacy & Assisted Reproduction

California surrogacy and assisted-reproduction attorney

L.A. Family Law Center has represented intended parents and other participants in hundreds of assisted-reproduction matters.

The firm advises clients concerning the agreements and parentage proceedings required for gestational-surrogacy and donor arrangements.

Gestational-surrogacy agreements

A gestational-surrogacy agreement establishes the rights and responsibilities of intended parents and a gestational carrier before embryo transfer.

The agreement may address:

  • Medical screening and treatment
  • Embryo transfer
  • Compensation and expense reimbursement
  • Insurance
  • Escrow funding
  • Travel and lost wages
  • Medical decision-making
  • Pregnancy-related conduct
  • Selective reduction and termination decisions
  • Confidentiality
  • Contact and communication
  • Delivery arrangements
  • Parentage proceedings
  • Events affecting the pregnancy or agreement

Each party must have independent legal representation.

Parentage proceedings

A surrogacy agreement does not by itself complete the legal parentage process.

The firm assists intended parents in obtaining court orders confirming parental rights and directing the preparation of birth records. Depending on the facts, the proceeding may occur before or after the child's birth.

Donor agreements

The firm prepares and reviews agreements involving:

  • Egg donation
  • Sperm donation
  • Embryo donation
  • Known donors
  • Anonymous or agency-arranged donors

These agreements may address parental intent, medical procedures, compensation, expenses, confidentiality, future contact, disposition of genetic material, and access to medical information.

Escrow services for assisted-reproduction matters

When separately retained, the firm may manage escrow funds for gestational-surrogacy and related assisted-reproduction matters. Escrow services are governed by a written agreement stating funding, disbursement, documentation, reporting, replenishment, holdback, and closing requirements.
